EQUIPMENT HIRE TERMS & CONDITIONS
1. Agreement
By entering into a hire with Lonsdale Hire Pty Ltd, the Customer agrees to these Terms & Conditions and confirms they are authorised to enter into this agreement. The Customer acknowledges that all equipment is hired at their own risk and must be used safely and correctly.
2. Identification & Payment
Valid identification may be required before equipment is released. Full payment, security deposits, and bond amounts may be required prior to hire. Lonsdale Hire Pty Ltd reserves the right to refuse hire at its discretion.
3. Hire Period
The hire period begins when the equipment leaves the Lonsdale Hire Pty Ltd premises and ends when it is returned and inspected. Additional charges apply for late returns. The Customer must notify Lonsdale Hire Pty Ltd immediately if equipment cannot be returned on time.
4. Condition of Equipment
The Customer acknowledges that all equipment has been inspected and is in good working condition unless otherwise noted. The Customer agrees to inspect the equipment before use and notify Lonsdale Hire Pty Ltd immediately of any faults or concerns.
5. Safe Use & Operation
The Customer agrees that equipment will only be used by competent and appropriately trained persons. All equipment must be operated in accordance with manufacturer instructions, workplace safety requirements, and all applicable Australian laws and regulations.
6. Prohibited Use
The Customer must not misuse, overload, alter, sub-hire, sell, or allow unauthorised persons to use the equipment. Equipment must not be used while under the influence of drugs or alcohol.
7. Responsibility for Loss or Damage
The Customer is fully responsible for any loss, theft, damage, misuse, vandalism, or destruction of the equipment during the hire period, regardless of cause. The Customer agrees to pay repair or replacement costs, including transport, labour, cleaning, downtime, and associated expenses.
8. Breakdown & Repairs
If equipment breaks down during normal operation, the Customer must stop using it immediately and contact Lonsdale Hire Pty Ltd. The Customer must not attempt repairs unless authorised in writing. Unauthorised repairs may result in additional charges.
9. Cleaning Charges
Equipment must be returned clean and in the same condition supplied. Cleaning fees may apply where excessive dirt, concrete, paint, mud, or other substances are present.
10. Fuel & Consumables
Fuel-powered equipment must be returned with the same fuel level supplied. Consumables including blades, drill bits, sanding discs, fuel, oils, and wear items may be charged separately.
11. Liability
To the maximum extent permitted by law, Lonsdale Hire Pty Ltd is not liable for any injury, death, property damage, loss of income, delays, or consequential losses arising from the use or failure of hired equipment.
12. Indemnity
The Customer indemnifies and holds harmless Lonsdale Hire Pty Ltd, its owners, employees, and agents from any claims, damages, costs, or liabilities arising from the hire, transport, storage, or use of the equipment.
13. Transport & Loading
The Customer is responsible for ensuring equipment is transported safely and legally. Any assistance provided by Lonsdale Hire Pty Ltd staff with loading or securing equipment is provided at the Customer's risk.
14. Recovery & Collection
If equipment is not returned when due, Lonsdale Hire Pty Ltd may enter premises where the equipment is believed to be located to recover it. Recovery costs, legal fees, and collection expenses will be payable by the Customer.
15. Cancellation & Refunds
Cancellations and refunds are at the discretion of Lonsdale Hire Pty Ltd. No refund will generally be provided once equipment has left the premises.
16. Privacy
Customer information may be collected and used for identification, payment processing, debt recovery, and business administration purposes.
17. Governing Law
These Terms & Conditions are governed by the laws of South Australia. Any disputes will be handled within the jurisdiction of South Australian courts.
18. Acceptance
The Customer accepts these Terms & Conditions by signing a hire agreement, accepting a quote, making payment, collecting or accepting delivery of equipment, or using the equipment. The Customer confirms that they have read and understood these Terms & Conditions and have been given the opportunity to ask questions before proceeding with the hire.
